In response to Rep. John Boehner's statement today that the delegate vote in the Committee of the Whole House is unconstitutional, DC Vote issues this statement from Executive Director Ilir Zherka:

"Contrary to Rep. Boehner's statement, in Michel v. Anderson the U.S. Court of Appeals affirmed the U.S. District Court for the District of Columbia decision that Congress has the Constitutional ability to allow delegates to vote in the Committee of the Whole. It is for the courts, not Rep. Boehner, to determine what is Constitutional and in this case they have made a definitive ruling. Delegates have voted in the Committee of the Whole for the past three years without challenge. DC asks that Rep. Boehner respect the judicial branch of government's authority in this matter and let this established practice stand, allowing over 600,000 tax-paying Americans in DC to have some small voice in their own governing."
