Washington (AP) - A group of D.C. residents and the city government are pressing ahead as they try to impose a commuter tax.
At a hearing Monday before a U.S. Appeals Court, attorneys argued that a congressional ban against such a tax is unconstitutional, because it discriminates against city taxpayers, who have no vote in Congress.
The lawyers note that 41 states have similar taxes. A U.S. District Court judge ruled in March of last year that such a ban was "manifestly inequitable" to the city, but not unconstitutional.
Without a commuter tax, D.C. leaders argue that residents are being forced to pay some of the highest taxes in the nation to provide adequate levels of services like road repairs.
It's unclear when the judge will rule on Monday's arguments.
